How Process Serving Works in Massachusetts

A service assignment starts with the actual papers, recipient, address, deadline, and legally required method. The server reviews practical details, makes attempts consistent with the assignment, records what occurs, and prepares the applicable proof or completion documentation.

The process usually begins when a party or attorney obtains the papers that must be served and sends the complete documents to an authorized server with the recipient’s information and deadline. The server reviews the assignment, confirms whether it can be accepted, and makes attempts consistent with the instructions and applicable law.

The method is not identical for every document. A summons and complaint, subpoena, Notice to Quit, probate citation, and court order can each be governed by different rules. The identity of the recipient also matters because service on an individual is different from service on a corporation, government body, or authorized agent.

If service is completed, the server prepares the applicable return, affidavit, or other completion documentation. Massachusetts Rule 4(f) addresses written proof for civil process. The requesting party should then follow the filing instructions for the particular court and case.

If service is not completed, useful information includes when and where attempts occurred and whether the address appears inaccurate or inaccessible. The requesting party can then decide whether to provide another lawful address, authorize further attempts, or ask the court for appropriate relief. A process server documents facts; the court decides disputed legal issues.
